1. Acceptance of Terms

By accessing or using Fluq ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Fluq provides AI agent fleet operations tooling, including real-time monitoring, event ingestion, policy enforcement, cost tracking, and orchestration capabilities for autonomous AI agents. The Service is provided "as is" and "as available".

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your API keys and passwords
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Transmit malicious code, viruses, or harmful software
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use the Service to monitor competitors or scrape data without permission
• Reverse engineer, decompile, or disassemble the Service
• Resell or redistribute the Service without written authorization

5. API Usage and Rate Limits

API usage is subject to rate limits and quotas based on your subscription tier. Excessive use beyond allocated quotas may result in throttling or suspension. We reserve the right to modify rate limits with reasonable notice.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you submit to the Service. We will not share your data with third parties except as described in the Privacy Policy.

7. Payment and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You agree to:

• Provide current, complete, and accurate billing information
• Pay all charges at the prices in effect when incurred
• Pay all applicable taxes

We reserve the right to change pricing with 30 days' notice. No refunds will be issued for partial months or years. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Data associated with terminated accounts may be deleted after 30 days.

9. Limitation of Liability

To the maximum extent permitted by law, Fluq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your use or inability to use the Service; (b) unauthorized access to or alteration of your transmissions or data; (c) any third-party conduct or content on the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in England and Wales.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
